USBC Reaches Legal Agreement With NY State Association

The United States Bowling Congress and the New York State USBC Bowling Association (NYSBA) have reached an agreement to end a lawsuit filed by the NYSBA.
The agreement sets forth a process for the creation of a new open stateassociation in New York and ensures the 2009 N.Y. State ChampionshipTournament will be held, as scheduled, in April. The agreement also willallow members still owed money from the 2008 tournament prize fund to beissued checks immediately.
Last October, USBC revoked the charter of the NYSBA after it wasdiscovered that Stephen Donahue of Weedsport, N.Y., the former manager ofthe NYSBA, embezzled approximately $274,000 from the NYSBA including aportion of the 2008 tournament prize fund. In response, NYSBA filed suit inNovember arguing that its charter had been unlawfully revoked by the USBC.Donahue recently pled guilty to felony grand larceny.
As a result of the lawsuit, the New York State Supreme Court issued atemporary restraining order preventing either side from, among otherthings, running the 2009 State Championship Tournament or paying out the2008 tournament prize fund.
Citing a mutual desire to promote the best interests of bowlers, bothparties now agree that the charter of the former NYSBA will remain revokedand its board of directors relieved of its duties and responsibilities.USBC will begin the process of forming a new open state association,allowing members in New York to elect a new board of directors within 90days.
Dennis Light, a practicing attorney from Westchester County who was namedpresident of the NYSBA after the discovery of Donahue's theft, has agreedto be Tournament Director for the 2009 State Championship Tournament inUtica, N.Y., which will be operated by USBC.
"Our goals are to protect the interests of bowlers in New York and makesure the State Tournament takes place," USBC Chief Operating Officer KevinDornberger said. "We believe this agreement with the former NYSBAaccomplishes that goal. Dennis Light was forthcoming with the mattersinvolving Mr. Donahue and I am optimistic Dennis will be a willing partnerto help bowlers in New York during this transition."
The agreement also clarifies that USBC will ensure any NYSBA youthscholarship awards that remain outstanding are paid.
"The underlying theft by Mr. Donahue was an irreconcilable event or, inother words, too large an obstacle for the NYSBA to overcome," Light said."The reformation and reorganization of a new open state association willgive the bowlers in New York a fresh start."
"This agreement recognizes the commitment both organizations have had topromoting the best interests of all bowlers in this state," Light said. "Itis my impression the parties are now satisfied and pleased that theresolution of this matter has preserved and further assures the process, bywhich, the USBC membership in New York will decide the future of USBCcertified bowling in their state."

The issues involving the USBC and NYSBA do not affect members or programsof the New York State USBC Women's Bowling Association (NYSWBA) or the NewYork State USBC Youth Association.
The United States Bowling Congress, as the national governing body,ensures the integrity and protects the future of the sport, providesprograms and services to nearly 2.5 million adult and youth members andenhances the bowling experience.

The Bowling Tip

Bowlers: This weeks tip will help you execute and repeat good shots by having your body set properly so that you can use the laws of physics to roll the ball and eliminate tension in your swing.
As I've mentioned in previous columns, too much upper body and head movement make it very difficult to repeat shots.
The purpose of the stance is to place the body in an athletic position, eliminate all unnecessary movements during the approach and reduce tension.
Resting forearms against the body, in the stance, will help reduce tension in the upper body.
How do we do this?
Here are the four steps in the proper order for setting posture.
1. Set the feet (toward your breakpoint).
2. Set your head (tilted over the ball).
3. Set your posterior (this is your balance point as you are swinging a heavy object).
4. Set the ball position close as noted above.
You are now in position to start a smooth approach. Maintain your body position and let the ball swing under your shoulder. You will find this easy to repeat shot after shot.
